GENERAL TERMS AND CONDITIONS OF CONTRACTING
1. INTRODUCTION

The conditions stipulated below will enter into force between the parties only when the seller has confirmed the order and provided the buyer with all the stated conditions.

3. COVERAGE OF OUR PRODUCTS

The use of this web platform, as well as any transaction carried out through it, is considered to be performed in Spain and, therefore, is subject to current Spanish laws and regulations, without prejudice to the applicable legislation depending on the consumer’s status.

These General Conditions aim to establish the regulatory framework for the signing of the Contract. These conditions will be supplemented, where applicable, by the corresponding Specific Conditions.

As a Consumer, the Contract is governed by Royal Legislative Decree 1/2007 of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter referred to as TRLGDCU).

4. CONTRACTING PROCEDURE — HOW CAN I BUY ONLINE?

To access the products offered by TONI CABAL and make a purchase, you must freely and voluntarily provide the personal data required.

In accordance with Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow these steps:

Click on the product you wish to select and press the “add to cart” button. <<The cart is located at the top right of the page>>.

If you wish to continue shopping, click the “continue shopping” button.

Once you have selected the products you wish to purchase and the number of units, click “checkout”.

Next, you must provide your personal details. You may log in or create an account to complete the order, or, if you prefer, make your purchase without registering, as a guest.

Then, provide a delivery address and select a shipping method.

On the same screen, on the right, you will find a summary of your cart with the selected products, price, taxes, and shipping costs (if applicable).

Finally, you must select the desired payment method and confirm your purchase using the “ORDER WITH PAYMENT OBLIGATION” button.

Before this button appears, you will see an informative clause on data protection, as well as access to the second information layer (detailed privacy policy) and access to these Terms and Conditions.

To process your purchase, you must read and accept both the Privacy Policy and these General Terms and Conditions of Contracting, which govern the completed transaction. You may download the General Terms and Conditions of Contracting if you wish.

You may also accept the receipt of commercial information and the invoice in electronic format.

TONI CABAL informs that the electronic document formalizing the contract will be properly stored, ensuring that it remains accessible to the user. The user may request it from their customer area or through our Customer Service contact methods.

5. TECHNICAL MEANS FOR ERROR CORRECTION

The user has technical means provided by TONI CABAL during the contracting process to identify and correct possible data entry errors. If the user identifies any errors, they may follow these steps:

· Customer Area: Access the customer area using the credentials provided during registration. Identify the corresponding transaction and select the option to correct data. Modify the incorrect data and confirm the changes.

· Customer Service: If the user prefers direct assistance, they may contact Customer Service through the available communication channels, indicating the incorrect information and providing the correct data for immediate update.

Once the transport company has taken charge of the product, any request for changes related to delivery must be handled directly with the transport company using the tracking number provided. Data correction in this context is subject to the transport company’s policies.

Additionally, for security reasons, if PayPal is chosen as the payment method, no changes to the shipping address will be allowed after the order is placed.

7. PRODUCT INFORMATION

The descriptions of the products offered on our site are based on the TONI CABAL product catalog, an online store specialized in perfumes.

Products are carefully selected, and we strive to display colors and features accurately. However, due to variations in monitor quality or resolution, users should carefully review product descriptions, which are not affected by such contingencies.

Availability of stock will also be indicated. If an error occurs and a product appears available but is not after purchase, TONI CABAL will inform the user in accordance with our “RETURN POLICY – Lack of stock” section.

8. PRICE INFORMATION

The price of each product or service is the one indicated on our website at the time of purchase and is expressed in Euros (€). Unless otherwise indicated, all prices include legally applicable taxes (Spanish VAT).

Prices may vary at any time, although such changes will not affect orders already placed.

If a manifest pricing error is detected, we will inform you immediately and allow you to reconfirm the order at the correct price or cancel it.

Shipping costs and applicable taxes will be itemized at checkout so the user can clearly understand the final price.

9. SALES PROMOTIONS

Activities considered as sales promotions include:

· Discount sales
· Sale or promotional offers
· Clearance sales
· Liquidation sales
· Sales with gifts
· Direct selling offers

Any promotional announcement will indicate its duration and any applicable special rules. Discount periods are freely determined by the Company.

For reduced-price items, the previous price will appear alongside the reduced price, except for newly introduced items.

If announcements do not include the information described above, it is understood that prices may vary depending on demand and do not correspond to a specific promotion—meaning they will be considered standard retail prices.

Gifts or incentives must be delivered within the legally permitted time frame, not exceeding three months from the promotion’s expiration date.

10. SHIPPING COSTS

Shipping policy:

· Shipping to mainland Spain is free for purchases over €90.
· For purchases under €90, a shipping fee starting at €6.50 applies.

11. CUSTOMS INFORMATION

If the delivery address is outside the EU, you may be required to pay import duties and taxes upon arrival. Any additional customs clearance costs will be borne by you. International shipments may be inspected or opened by customs authorities.

12. PURCHASES FROM ABROAD

To deduct VAT from international invoices, it is essential to provide a National ID or Passport number.

Shipping costs, applicable taxes, and other charges will be itemized at checkout.

An estimated deposit for import duties may be charged during order processing. These funds will be used to pay import taxes once your order reaches the destination country.

If estimated import tax is not shown at checkout, customs fees will be borne by the recipient.

13. OFFER AND ACCEPTANCE

The contracting procedure and pre-contractual information are in Spanish. This is the language used to formalize the contract, unless otherwise indicated before starting.

14. INFORMATION ON PAYMENT METHODS

Payment is made at the time of purchase, and TONI CABAL will send a confirmation email indicating the estimated delivery date.

TONI CABAL does not access or store sensitive payment information, except what is strictly necessary for management. Only the corresponding financial institution processes such data.

TONI CABAL reserves the right to cancel orders under the conditions established.

15. WHAT PAYMENT METHODS CAN I USE?

Payments may be made via:

· Credit or debit card: Visa, MasterCard, Maestro, Discover Card, Diners Club, UnionPay.
By clicking “Order with payment obligation,” you confirm that the card used is yours.

· PayPal, ShopPay, or GooglePay
If you choose PayPal, ShopPay, or GooglePay, no changes to the shipping address are allowed after placing the order.

Once the order is placed, the company will confirm it immediately.

16. IS IT SAFE TO ENTER MY PAYMENT DETAILS?

Our website uses SSL encryption to protect payment data. Confidential credit or debit card information is securely transmitted directly to the financial institution.

For online payment verification, the system may request authentication and authorization from your issuing bank.

17. MY CARD WAS DECLINED — WHAT CAN I DO?

If your card is declined, contact your bank first to determine the reason.

Common causes include:

· Card not activated for secure online payments
· Expired card
· Credit limit reached
· Incorrect data entry

18. MY CARD HAS BEEN USED FRAUDULENTLY — WHAT SHOULD I DO?

You must notify TONI CABAL as soon as possible via email or phone.

19. INVOICE INFORMATION

Invoices are generated electronically if authorized. Otherwise, a paper invoice will be included with your order.

Changes cannot be made after the invoice is issued.

Duplicate invoices will only be issued to the contract holder.

20. SHIPPING POLICY
· Delivery time

The maximum delivery time via GLS or UPS is 2 to 5 business days after payment confirmation.

No deliveries are made on weekends or holidays.

21. PLACE OF DELIVERY

TONI CABAL will deliver the product in perfect condition to the indicated address within Spain.

We also offer in-store pickup at our physical location in Madrid within 24 hours at no additional cost.

22. TRANSFER OF RISK AND OWNERSHIP

Delivery is considered made once the product is available to the User or a designated third party. Risk transfers upon availability, unless the consumer chooses their own transporter.

23. DELIVERY PROBLEMS

If there is any visible discrepancy upon delivery, do not accept the package and note it on the delivery receipt.

If the issue is detected after opening, contact us immediately at info@tonicabal.com with your details, order number, photo, and description.

24. LEGAL WARRANTY

All perfumes comply with expected quality and authenticity standards. If a product fails to meet these, the customer has the right to repair, replacement, or refund.

25. RETURN POLICY
· Right of withdrawal

Consumers have 14 calendar days from receipt to return products not included under Article 103 exceptions.

Return shipping costs are borne by the customer unless the product is defective or we made an error.

Returns must be in original condition and packaging.

· Refunds
Refunds will be processed within 14 days after receiving the product.

· Lack of stock
If a purchased item is out of stock, you will be notified and refunded immediately.

26. MINORS

TONI CABAL services are intended only for users over 18.
Minors must not use our services or submit personal data.

27. DISPUTE RESOLUTION

Relations are governed by Spanish law. Disputes will be resolved in the courts of the consumer’s domicile.
