GENERAL TERMS AND CONDITIONS OF CONTRACTING

1. INTRODUCTION

1.1. These General Terms and Conditions regulate the contracting procedure in which the party responsible for the contractual offer is WORLDWIDE DROPS GROUP, S.L., located in Spain.

1.2. The User declares to have been previously informed. By clicking “I have read and accept the General Conditions,” the User fully accepts these Conditions.

1.3. WORLDWIDE DROPS GROUP, S.L. may modify these Conditions at any time and without prior notice.

2.2. User

Any individual over 18 years of age with legal capacity to contract.

3. PURPOSE

3.1. These Conditions govern the sale of products between Toni Cabal and the User.

4. PRODUCT FEATURES

4.1. Detailed descriptions of each product will be available on its respective product page within the platform.

5. PRICE AND AVAILABILITY

5.1. Each item displays its final total price, including applicable taxes.

5.2. Information about products is provided accurately and is kept up to date.

5.3. Prices may vary. The User is responsible for checking the most current version. Toni Cabal is not responsible for cached versions displaying outdated prices.

5.4. If a product is not available, the User will be notified and refunded.

6. ORDER

6.1. Placing an order and completing payment constitutes a contractual request by the User.

6.2. The order becomes binding when the User clicks “I have read and accept the General Conditions. Order with payment obligation.”
Order confirmation will be sent via email within a maximum of 24 hours.

7. SHIPPING COSTS, DELIVERY AND TRANSPORTATION

7.1. Delivery will be made to the address provided by the User during checkout.

7.2. Shipping costs will be calculated according to destination, weight, and order characteristics.

7.3. Delivery times may vary due to logistics or courier-related issues.

7.5. Customs Duties

Customs fees, duties, or import taxes will be borne by the purchaser.

8. PAYMENT METHOD

8.1. Payments may be made by credit/debit cards and PayPal, processed through the Shopify payment gateway.

9. DELIVERY AND CONTRACT DURATION

9.1. The maximum delivery period shall be 30 calendar days.

9.2. If the product is unavailable, the User will receive a refund within a maximum of 30 days.

9.3. The contract will remain in force as long as pending obligations exist between the parties.

10. TERMINATION OF THE CONTRACT BY THE CONSUMER

10.1. The User may cancel the order before the contract is formalized.
Once formalized, the right of withdrawal will apply.

11. WARRANTIES

11.1. Products will be considered compliant if they meet the legal requirements and the characteristics advertised.
Damage caused by improper use is not covered.

11.2. The legal warranty period is 2 years.
The User must report any lack of conformity within 2 months of becoming aware of it.

12. LANGUAGE OF THE CONTRACT

The contract is formalized in Spanish.

13. RIGHT OF WITHDRAWAL

The User has 14 calendar days from receipt of the goods to exercise the right of withdrawal without justification.

To exercise this right, the User must notify:

13.1. Consequences of Withdrawal

  • Refund issued within 14 days.

  • Refund processed through the same payment method used in the purchase.

  • Refund may be withheld until the goods are received.

  • The User must return the goods within 14 days.

  • Return shipping cost: maximum estimated €50.

  • If withdrawal is due to lack of conformity, Toni Cabal will bear the return cost.

  • The User will be responsible for any diminished value due to handling beyond what is necessary to verify the nature or characteristics of the goods.

14. CLAIMS

14.1. Complaint forms are available upon request.

15. DATA PROTECTION

Personal data processing is detailed in the corresponding Privacy Policy.

16. DISCLAIMER OF LIABILITY

The company shall not be liable for:

  • Incorrect or improper use of the website

  • Damage caused by third parties

  • Service failures or interruptions

  • Information found on external links

17. VALIDITY OF THE CONTRACT

If any clause is declared null or unenforceable, the remaining provisions shall remain valid.

18. APPLICABLE LAW AND JURISDICTION

These Conditions are governed by Spanish law.
For disputes, the parties submit to the Courts and Tribunals of Barcelona.

19. RECORD DECLARATION

The file “Web Users” is duly registered and declared.

20. OTHER PROVISIONS

Toni Cabal may modify the data policy according to new data flows or internal changes.
